Terms &  Conditions 

1. Any quotations issued between Everest Rope Access & Roofing and the client is valid for 4 - 6 weeks from the quotation date. After this time it may be necessary to re-quote due to the sudden increase cost of materials.

 

2. All works carried out by Everest Rope Access & Roofing or a sub contractor of Everest Rope Access Roofing need to be pre approved before works commence. This is so we can legally gain access to the needed property. The pre approval can be submitted by either a written letter or via email. We require written acceptance 7 days prior to the works commencement date, within this 7 day period the client has the right to cancel the project.

 

3. If you, the client unexpectedly cancel any upcoming projects within 7 days of the work commencement, you will be invoiced for 15% of the original quotation price. This charge is to cover administration fees & prior project organisation.

4. Everest Rope Access cannot be held responsible for any delays of the specified times on contracts due to delays caused by additional instruction by the client, third parties,

unavailability of materials from third parties, adverse weather conditions, explosions or circumstances beyond our control, *force majeure.

5. Any materials on site installed or stored in conjunction with each contract remain the property of Everest Rope Access & Roofing , until payment is made in full.

6. All materials of works damaged by third parties remain the responsibility of the client whilst works are in progress. Client must pay for any damage or the loss of materials or works by third parties unless valid proof is produced that Everest Rope Access & Roofing have been negligient

7. You agree to give us all necessary access to your property so that we can undertake the work to the agreed schedule. If access is required to your neighbour`s or adjacent property. it is you, the client responsibility to obtain written permission and provide us, the contractor with a copy of acceptance prior to the commencement of works. You also agree to facilitate the use of all mains services including electricity and water so that we can carry out the works.

8. If any planning authorisation is required for the work, this should be obtained by you prior to the commencement of the project. Everest Rope Access & Roofing cannot be held responsible if you, the client have failed to obtain permission from local authorities

9. All invoices are strictly NET and are due for payment within 7 - 14 days after the job completion date unless otherwise agreed. Any invoices unpaid after 30 days after invoice due date will be subject to an interest charge of 5% above the base quote, if the invoice is still not paid 60 days after invoice due date we will have no other choice than to pass your details on to a local debt collection agency. All invoices are subject to VAT at standard rate unless otherwise stated due to special conditions.

10. Everest Rope Access & Roofing are very conscientious of our work and would like the opportunity to take photographs of various aspects of completed works. If you object to photographs being taken off your property when completed, please inform our office in writing. These photographs may be used for online advertising, but be rest assured that no details will ever be revealed as to the identity of the building.

11. Payments can be made via bank transfer, by cheque or by cash. Please note that all cheque payments incur a £25 administration fee. Cheques are to made payable to ' Everest Rope Access & Roofing Limited’ All payment information can be found at the bottom of your invoice. Payment terms, interim payments and deposits are all set out in either the contract or order confirmation document. Unless specific terms are set out within the quotation, terms of payment are strictly on receipt of invoice. Everest Rope Access & Roofing reserves the right to charge interest on any late payment of 5% plus the current Monzo Business banking base rate.

12. We hold £5,000,000 Public liability cover at all times and this can be inspected upon request. Clients are reminded it is a common requirement of policies issued by Domestic Building Insurers to be advised when building works are undertaken on the property.

13. All customers will benefit from a full guarantee on our workmanship for a period of 12 months after practical completion of works. The guarantee only covers new work and does not apply to any repair work carried out. Repairs to building, roof, infrastructure or any existing work is not covered by our guarantee.

Guarantees on materials and products run in accordance with the manufactures warranty periods where applicable. Our guarantee covers all new work and new materials used in construction but does not guarantee the integrity of any existing structures, materials or decorations. Subsidence issues are not covered within our guarantee period. In event of failure after the guarantee period we will be happy to investigate the cause and negotiate a solution to the problem without delay (if it is found our company is wholly responsible for the failure) and carry out any agreed repairs as soon as possible. Charges may apply for remedial work carried out beyond guarantee dates or to items not covered by the guarantee. Decorations are signed off on completion and not covered by the guarantee.

All new build properties are covered by a building warranty further details to be discuss with the client. There is also options for 5 year and 10 year guarantee periods on client request.

 

14. No responsibility can be taken by Everest Rope Access & Roofing for the presence of perished, infested or rotten timbers (or any other materials) in existing structures such as structural timbers or other timber, windows and frames whether detect or undetected at the time of contract.

15. Whilst we endeavour to protect all existing surfaces such as floors, carpets and soft furnishings with dust sheets and plastic sheeting. If found that Everest Rope Access & Roofing have caused damaged we take full responsibility & will pay for all damage to be repaired or replaced. All floors, carpets & soft surfaces will be photographed from our employees prior to the job starting.

 

16. Builders waste is deemed to be waste generated by the contractor whilst carrying out building works and includes materials taken down or demolished by the contractor. The material can be used by the client on request or contractor for hardcore or masonry infill. All on site or road side skips & contents remains the property of you, the client until collection by the waste company.

17. This Agreement is to be governed by the law of Scotland where Everest Rope Access & Roofing are performed or in another jurisdictions that may have registered Advanced Access Engineering offices.

18. Replication of existing design: If a client makes a request for a new product to match an existing or original design specification, we will endeavour to match the specifications of the requested design at the sole risk of you, the client. When matching the design of another product that is existing, original or otherwise, it should be understood that the source or original design may have unknown design flaws that could render the product and any duplication of the original product, meaning it could be unfit for purpose in some way. An unproven design can be reproduced by us but it should be understood that this will always be at the sole risk of the you, the client and Everest Rope Access & Roofing will bear no responsibility for the product’s functionality or fitness for purpose

19. The main contractor being Everest Rope Access & Roofing, may employ both direct and sub-contract labour to work on site. Each individual contractor takes full responsibility for their own third party liability. The main contractor will oversee all works to completion and takes full general and operational responsibility in the running of any contract agreed with the client

20. Everest Rope Access & Roofing reserves the right to terminate an agreed contract if the client is in breech of these terms and conditions.
